Cappup Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the Cappup mobile application, cappup.app, and related services operated by Freedom Street LLC (“Cappup,” “we,” “us,” or “our”).

By downloading, accessing, creating an account with, purchasing a subscription through, or otherwise using Cappup, you agree to these Terms.

If you do not agree to these Terms, do not use Cappup.

Our Privacy Policy explains how we collect, use, store, and protect information and is incorporated into these Terms by reference.

1. About Cappup

Cappup is a pet-care tracking application designed to help dog owners and caregivers record and review information such as:

  • meals;
  • potty activity;
  • symptoms;
  • weight;
  • pet profile information;
  • notes;
  • pet photos; and
  • other supported routine information.

Cappup may also provide summaries, reminders, organizational tools, premium features, or other pet-care-related functionality.

Cappup is intended to help users organize information. It is not a veterinary service and does not replace professional veterinary care.

2. Eligibility

Cappup is intended for adult dog owners and caregivers and is not directed to children under 13.

You must be at least 13 years old to use Cappup.

If you are under the age of majority where you live, you may use Cappup only with the permission and supervision of a parent or legal guardian who agrees to these Terms on your behalf.

By using Cappup, you represent that you meet these eligibility requirements.

3. Your Account

Some Cappup features require an account.

When creating or maintaining an account, you agree to:

  • provide accurate and current information;
  • maintain the confidentiality of your password and account credentials;
  • use your own account;
  • promptly update information when necessary; and
  • notify us if you believe your account has been compromised.

You are responsible for activity occurring through your account to the extent permitted by applicable law.

You may not share credentials in a manner intended to bypass subscription, security, or account restrictions.

We may take reasonable steps to protect accounts from suspected unauthorized access, fraud, abuse, or security threats.

4. Pet Information and User Content

Cappup allows you to enter information and upload content relating to your pet, including pet profile information, activity records, notes, symptoms, weight information, and photos.

You retain ownership of content you provide to Cappup.

By submitting information or content, you grant Freedom Street LLC a limited, non-exclusive license to host, store, process, reproduce, and display that content only as reasonably necessary to:

  • operate Cappup;
  • synchronize your information;
  • provide requested features;
  • maintain and secure the service;
  • troubleshoot technical issues; and
  • comply with applicable law.

This license ends when the information is deleted from our active systems, subject to reasonable backup, security, legal, and retention requirements described in our Privacy Policy.

You represent that you have the right to provide any content you upload.

You should not upload:

  • content that violates another person’s privacy or intellectual-property rights;
  • unlawful or harmful material;
  • malware or malicious code;
  • human medical records;
  • unnecessary sensitive personal information about another person; or
  • content that you do not have permission to use.

5. Cappup Is Not Veterinary Advice

Cappup is an organizational and informational pet-care tool.

Cappup does not provide veterinary medical advice, diagnosis, treatment, prescriptions, or emergency veterinary services.

Information recorded, displayed, summarized, or organized through Cappup should not be interpreted as a diagnosis or recommendation from a veterinarian.

Always seek advice from a qualified veterinarian regarding questions about your pet’s health.

Do not delay professional veterinary care because of information stored in or presented by Cappup.

If you believe your pet is experiencing a medical emergency, contact a veterinarian or emergency veterinary facility immediately.

You remain responsible for decisions relating to your pet’s health, diet, medications, treatment, and care.

6. Accuracy of Pet Records

Cappup relies substantially on information entered by you.

You are responsible for reviewing the accuracy of entries such as:

  • meal records;
  • symptom descriptions;
  • dates and times;
  • weight measurements;
  • potty records;
  • pet profile information; and
  • notes.

Cappup does not guarantee that user-entered information is accurate, complete, or appropriate for any particular purpose.

Technical errors, connectivity problems, device failures, synchronization issues, user mistakes, or service interruptions may affect stored or displayed records.

You should not rely on Cappup as the sole repository for information that is critical to your pet’s health or safety.

7. Free and Premium Features

Cappup may provide both free and paid features.

We may change which features are included in free or paid plans as Cappup evolves, provided that changes to active paid subscriptions are handled consistently with applicable law and Apple’s requirements.

Features advertised as part of an active subscription will be provided during the applicable subscription period subject to these Terms.

8. Auto-Renewable Subscriptions

Cappup may offer premium features through auto-renewable subscriptions purchased through Apple’s App Store.

Available subscription options, including their:

  • name;
  • duration;
  • price;
  • included features;
  • free trial, if any; and
  • other material purchase terms

will be displayed before you confirm a purchase.

Billing

When you purchase a subscription through the Cappup iOS app, payment is processed through your Apple Account and Apple’s In-App Purchase system.

Freedom Street LLC does not receive or store your complete payment-card information.

Your subscription automatically renews according to the terms displayed at purchase unless you cancel it through Apple before renewal.

Prices may vary by country, currency, taxes, subscription option, promotional offer, or changes permitted by Apple and applicable law.

Free Trials and Promotional Offers

Cappup may offer free trials, introductory pricing, promotional offers, or offer codes.

The duration and applicable price following a free trial or promotional period will be displayed before purchase.

Unless canceled in accordance with Apple’s subscription terms, a qualifying free trial or promotional offer may convert to a paid auto-renewable subscription when the promotional period ends.

Eligibility for introductory or promotional offers may be determined by Apple.

Managing or Cancelling a Subscription

Subscriptions purchased through Apple’s App Store are managed through your Apple Account.

You can manage or cancel your subscription using Apple’s subscription-management controls.

Deleting Cappup from your device does not automatically cancel a subscription.

Deleting your Cappup account also does not automatically cancel an App Store subscription.

If you want to stop future subscription billing, you should cancel the subscription through Apple.

Restore Purchases

Where supported, Cappup provides a method for eligible users to restore App Store purchases or subscription entitlements associated with their Apple Account.

Refunds

Purchases made through Apple’s App Store are subject to Apple’s billing and refund policies.

Requests for App Store refunds generally must be submitted to Apple.

Freedom Street LLC cannot guarantee approval of a refund request made to Apple.

9. Account Deletion

You may request deletion of your Cappup account from within the app.

To delete your account:

  1. Open Cappup and sign in.
  2. Open Settings.
  3. Select Delete Account.
  4. Follow the confirmation steps.

Account deletion is intended to permanently remove your Cappup account and its associated Cappup cloud data from our active systems, subject to limited retention permitted or required by law and routine backup retention described in our Privacy Policy.

Deleting your account is different from:

  • signing out;
  • deleting the Cappup app from your device; or
  • cancelling an App Store subscription.

Deleting your Cappup account does not necessarily cancel an active Apple subscription.

Once an account has been deleted, some information may not be recoverable.

10. Acceptable Use

You agree not to use Cappup to:

  • violate applicable laws or regulations;
  • interfere with the operation or security of Cappup;
  • attempt unauthorized access to another user’s account or information;
  • probe, scan, or test Cappup systems without authorization;
  • circumvent authentication, subscription, or security controls;
  • upload malicious software or code;
  • impersonate another person or organization;
  • engage in fraud;
  • abuse account creation, password recovery, or other service functionality;
  • use automated systems to access Cappup in a manner that places unreasonable load on our infrastructure;
  • reverse engineer or attempt to extract Cappup source code except where such restriction is prohibited by applicable law; or
  • use Cappup in a manner that infringes the rights of Freedom Street LLC or any third party.

We may restrict access when reasonably necessary to protect Cappup, its users, service providers, or systems.

11. Intellectual Property

Cappup, including its software, design, branding, logos, illustrations, interfaces, text, graphics, and other materials created by or for Freedom Street LLC, is owned by Freedom Street LLC or its licensors and is protected by applicable intellectual-property laws.

Except for the limited rights necessary to use Cappup in accordance with these Terms, no rights in Cappup’s intellectual property are transferred to you.

You may not copy, reproduce, distribute, sell, sublicense, modify, or commercially exploit Cappup or its proprietary materials except with our written permission or where applicable law expressly permits such activity.

“Cappup,” its logos, branding, and related marks may not be used in a manner that suggests endorsement or affiliation without permission.

12. App License and Apple Terms

Cappup is distributed through Apple’s App Store.

Apps obtained through the App Store are licensed rather than sold.

Your license to use the Cappup iOS application is also subject to Apple’s applicable App Store terms, Apple Media Services Terms and Conditions, and Apple’s Standard Licensed Application End User License Agreement (“Apple Standard EULA”), unless a different valid license agreement expressly applies.

The license permits you to use Cappup on Apple-branded devices you own or control as permitted by Apple’s applicable usage rules, including applicable Family Sharing rights.

If these Terms conflict with mandatory terms imposed by Apple for distribution of the Cappup iOS application, Apple’s applicable requirements control to the extent of that conflict.

13. Apple Is Not Responsible for Cappup

These Terms are between you and Freedom Street LLC, not Apple.

Freedom Street LLC, and not Apple, is responsible for Cappup and its content, operation, maintenance, and support.

Apple has no obligation to provide maintenance or support services for Cappup.

To the extent required under Apple’s applicable terms, Apple and its subsidiaries are third-party beneficiaries of the provisions governing your use of the Cappup iOS application and may enforce applicable license terms against you.

14. Third-Party Services

Cappup relies on third-party technology and services.

These may include services provided by:

  • Apple;
  • Supabase;
  • Hostinger;
  • Superwall; and
  • other infrastructure or service providers identified in our Privacy Policy.

Third-party services may be governed by their own terms and privacy policies.

You agree to comply with applicable third-party terms when using Cappup.

We do not control all aspects of third-party services and cannot guarantee that they will always be available, uninterrupted, or error-free.

Changes or interruptions to third-party services may affect Cappup functionality.

15. Internet and Device Requirements

Certain Cappup features require:

  • a compatible Apple device;
  • a supported version of iOS;
  • an internet connection;
  • an active Cappup account; or
  • access to Apple’s App Store or related services.

You are responsible for your device, internet connection, mobile-data charges, Apple Account, and other services necessary to use Cappup.

Cappup may not function fully when required connectivity or third-party services are unavailable.

16. Updates and Changes to Cappup

We may update Cappup to:

  • add or remove features;
  • improve performance;
  • address security issues;
  • comply with laws or platform requirements;
  • change compatibility; or
  • maintain the service.

Some updates may be necessary to continue using Cappup.

We do not guarantee that every existing feature will remain available indefinitely.

However, changes affecting paid subscriptions will be handled in accordance with applicable law and Apple’s requirements.

17. Availability of the Service

We aim to provide a reliable service, but Cappup may occasionally be unavailable because of:

  • maintenance;
  • software updates;
  • network outages;
  • hosting-provider problems;
  • security incidents;
  • technical failures;
  • events outside our reasonable control; or
  • other operational circumstances.

We do not guarantee uninterrupted or error-free availability.

18. Suspension and Termination

You may stop using Cappup at any time.

You may delete your account through the app as described above.

We may suspend or restrict access to Cappup when reasonably necessary because of:

  • violation of these Terms;
  • fraud or abuse;
  • threats to Cappup’s systems or other users;
  • legal requirements; or
  • circumstances where continued access could cause harm.

Where reasonably appropriate and legally permitted, we may provide notice before terminating access.

Termination does not eliminate rights or obligations that by their nature should survive termination, including provisions relating to intellectual property, disclaimers, liability, disputes, and applicable payment obligations.

19. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Cappup and its related services are provided “as is” and “as available.”

Freedom Street LLC does not warrant that:

  • Cappup will always be available;
  • Cappup will be free of errors or interruptions;
  • all data will always synchronize successfully;
  • information will never be lost;
  • Cappup will meet every user’s individual requirements; or
  • information entered into or displayed by Cappup will be accurate or complete.

Some jurisdictions do not permit certain warranty disclaimers, so portions of this section may not apply to you.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

20. Limitation of Liability

To the maximum extent permitted by applicable law, Freedom Street LLC and its owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of or inability to use Cappup.

This includes, where legally permitted, damages relating to:

  • lost or unavailable pet records;
  • service interruption;
  • loss of data;
  • device or connectivity problems;
  • reliance on information recorded or displayed in Cappup;
  • third-party services; or
  • decisions concerning your pet’s care.

Cappup is not responsible for veterinary outcomes resulting from decisions made without appropriate professional veterinary consultation.

Nothing in these Terms limits liability that cannot legally be limited or excluded under applicable law.

Consumer rights provided by applicable law remain unaffected.

21. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Freedom Street LLC and its affiliates, officers, employees, and contractors from claims, liabilities, damages, losses, and reasonable expenses resulting from:

  • your unlawful use of Cappup;
  • content you provide in violation of another person’s rights;
  • your material violation of these Terms; or
  • fraud or intentional misuse of the service.

This provision does not apply where prohibited by applicable consumer law.

22. Legal Compliance

You agree to use Cappup in compliance with applicable laws.

You represent that you are not prohibited from using Cappup under applicable United States sanctions or export-control laws.

Cappup may not be used where use of the application would violate applicable export restrictions, sanctions, or other legal requirements.

23. Privacy

Your use of Cappup is also governed by the Cappup Privacy Policy.

The Privacy Policy describes, among other things:

  • information Cappup processes;
  • cloud storage;
  • pet records and photos;
  • service providers;
  • account deletion;
  • retention;
  • security; and
  • your privacy choices and rights.

The Privacy Policy is available through cappup.app and within the Cappup application.

24. Changes to These Terms

We may update these Terms when Cappup, our business practices, applicable laws, or platform requirements change.

When we update these Terms, we will revise the Last Updated date above.

For material changes, we may provide additional notice through the application, website, email, or another appropriate method.

Where applicable law requires consent to materially changed terms, we will request that consent.

Continued use of Cappup following the effective date of updated Terms constitutes acceptance where permitted by applicable law.

25. Governing Law

Except where applicable consumer law requires otherwise, these Terms and disputes concerning them are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles.

Nothing in this section deprives you of mandatory protections or rights available under the laws of the jurisdiction where you live.

26. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

Any invalid or unenforceable provision will be interpreted or modified only to the extent necessary to make it enforceable where permitted.

27. No Waiver

If Freedom Street LLC does not immediately enforce a provision of these Terms, that does not waive our right to enforce that provision later.

28. Entire Agreement

These Terms, together with the Cappup Privacy Policy and any additional terms presented in connection with a particular feature, constitute the agreement between you and Freedom Street LLC regarding your use of Cappup.

For the iOS application, Apple’s applicable App Store terms and Standard EULA also apply as described above.
